In 1996, California voters passed Proposition 215 regarding the use of marijuana and in some cases concentrated cannabis for medical purposes by seriously ill patients. The Proposition requires that patient have their primary physician recommend the drug to provide relief. The Proposition also prohibits the State from threatening civil or criminal penalties for qualified patients who possess or grow marijuana.

Health & Safety Code 11006.5. states that "Concentrated cannabis" means the separated resin, whether crude or purified, obtained from marijuana.” Concentrated cannabis contains high amounts of tetrahydrocannabinoal (THC) which is a very active part of marijuana.

Health & Safety Code 11357. (a) states that "Except as authorized by law, every person who possesses any concentrated cannabis shall be punished by imprisonment in the county jail for a period of not more than one year or by a fine of not more than five hundred dollars ($500), or by both such fine and imprisonment, or shall be punished by imprisonment in the state prison."
