In every case the severity of the penalties involved in the selling of marijuana differ and are affected by various factors, including the age of the buyer.

Health and Safety Code 11360 (a) states that "Except as otherwise provided by this section or as authorized by law, every person who transports, imports into this state, sells, furnishes, administers, or gives away, or offers to transport, import into this state, sell, furnish, administer, or give away, or attempts to import into this state or transport any marijuana shall be punished by imprisonment in the state prison for a period of two, three or four years."

Listed below are some general penalties regarding marijuana selling convictions:

• Selling any amount of marijuana to an adult over the age of eighteen may result in a prison term of up to 4 years.
• Selling marijuana to a minor who is under the age of fourteen may result in up to 7 years of incarceration.
• Selling marijuana to a minor who is over the age of fourteen may result in a prison term of up to 5 years.

There are many situations which may lead up to a marijuana selling arrest, which include the selling of the drug to an undercover police officer during a “sting operation” or observation by a third party of an individual allegedly selling the drug.

Although it is a Felony to sell marijuana in California, giving a small amount of marijuana (less than one ounce) to another individual is considered a misdemeanor and may be penalized by a $100 fine.
